On March 10, 2010 entered into force the regulation implementing the Code Property Industrial, referred to Legislative Decree February 10, 2005, no. 30.
It outlines the framework of the procedures provided by the Articles 147, 149, 151, 184, 195, 197, 212 and 214 of that Code, following the criteria of simplification and rationalization of administrative burden. Among other things, there are governed the procedures for filing notice of opposition. This will add another piece in the definition of the administrative opposition procedure to the registration of trademarks. The effective use of this procedure, however, will require the issuing of a decree by the Minister of Economic Development that sets the terms and conditions of payment of the Opposition. When the procedure is finally completed, it will be possible at last to administratively oppose the registration of a mark, before its issuance, with significant cost.
